1. About Heep

Heep is a software platform designed to help restaurants manage guest messages, missed calls and reservations across multiple channels.

Heep is operated and owned by Canigou & Co, a French company.All services are provided under this legal entity.

2. Acceptance of terms

By accessing or using Heep, you confirm that you have read, understood and accepted these Terms and our Privacy Policy.

These Terms apply to all users, including visitors, customers and account holders.

3. Use of the service

You agree to use Heep only for lawful purposes and in compliance with applicable laws and regulations.

You must not:
- Use Heep for fraudulent, illegal or abusive activities
- Attempt to disrupt, overload or interfere with the platform
- Bypass or attempt to bypass security or access restrictions
- Use Heep in a way that could harm other users, restaurants or third parties
We reserve the right to restrict or suspend access if misuse is detected.

4. Account registration

Some features require creating an account.

You agree to:
- Provide accurate and up to date information
- Keep your login credentials confidential
- Be responsible for all activity under your account

If we detect suspicious activity or a breach of these Terms, we may suspend or terminate your account without prior notice.

5. Subscription, pricing and payments

Some services are offered under paid subscription plans.

By subscribing, you agree to:

- Authorize recurring charges where applicable

Unless required by law or explicitly stated otherwise, subscription fees are non refundable.

6. Custom features and integrations

Heep may offer custom features or integrations on a case by case basis.

Basic setup may be included. More complex integrations, custom workflows or specific developments may result in additional fees.

Any additional cost will be communicated and approved before work begins.

7. Intellectual property

All content, software, features and functionalities provided by Heep are the exclusive property of Canigou & Co or its licensors.
You may not copy, modify, distribute, reverse engineer or create derivative works without prior written permission.
You retain ownership of your data. We only process it to provide the service, as described in the Privacy Policy.

8. Service availability

We aim to provide a reliable service, but we do not guarantee uninterrupted or error free operation.
Temporary interruptions may occur due to maintenance, updates or technical issues.

9. Termination

We may suspend or terminate your access to Heep at any time if you breach these Terms.
Upon termination:
- Your access to the platform will stop
- Any outstanding fees become immediately due
- We may delete or anonymize your data in accordance with our Privacy Policy
You may stop using Heep at any time. Subscription cancellation terms depend on your plan.

10. Limitation of liability

To the maximum extent permitted by law, Heep and Canigou & Co shall not be liable for indirect, incidental or consequential damages.

This includes loss of revenue, loss of data, business interruption or missed opportunities resulting from use or inability to use the service.

Heep is a support and automation tool. Final responsibility for reservations, guest communication and operations remains with the restaurant.

11. Disclaimer of warranties

Heep is provided “as is” and “as available”.
We make no warranties regarding
- Fitness for a particular purpose
- Accuracy or completeness of automated responses
- Guaranteed results in terms of bookings or revenue

12. Changes to these terms

We may update these Terms from time to time.

The effective date will always reflect the latest version.
Continued use of Heep after changes means acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by French law.
Any dispute arising from these Terms or the use of Heep shall fall under the exclusive jurisdiction of the courts of France.
